Prime Street, LLC (“PrimeStreet”, “we”, or “us”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.

This Privacy Policy describes the types of information we collect from you or that you may provide when you download, install, register, access or use the PrimeStreet™ mobile application (the “App”), our practices for collecting, using, maintaining, protecting, and disclosing that information, and the choices you can make about the way in which your information is collected and used when you use our App. 

This Privacy Policy applies to information we collect when you use our App and information you provide when you use our App. 

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is to not download, install, register, access or use our App. By downloading, installing, registering, accessing or using our App, you agree to this Privacy Policy. 

Updates and Effective Date

We reserve the right to make changes to our Privacy Policy from time to time for any reason, including to reflect changes in the function of our App. If we make a change to this Privacy Policy that materially reduces your rights or significantly changes the way we use or share your data, we will notify you via email or a display on our App.  If you object to any of the changes we make, your choice is to stop using our App.  By continuing to use our App following our posting of such changes, you agree to our Privacy Policy as modified.  The “Effective Date” identified at the beginning of this Privacy Policy is the date this Privacy Policy was most recently updated.

Information We Collect About You And How We Collect It

We collect several types of information from and about users of our App.  

Information we collect on or through our App may include:

Information that you choose to provide to us:

• When you download, register with or use our App, we may ask you to provide information by which you may be personally identified, such as name, address, e-mail address, telephone number, professional license number (“personally identifiable information”). We may also ask you to provide information related to your professional preferences such as, the type of clients and properties, your work availability, and coverage area.  

 

Information we collect through automatic data collection technologies. 

When you download, install, access, and use the App, it may use technology to automatically collect:

• Usage Details. When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use through the App.
• Message Details.  We may collect information regarding your use of the message feature of the App, including message content, recipient information, and other data related to messages sent or received through the App.
• Device Information.  We may collect information about your mobile device and internet connection, including the device’s unique device identifier number, IP address, operating system, browser type, mobile network information and the device’s telephone number.
• Location Information.  This App collects real-time information about the location of your device regardless of whether or not the App is used through GPS, Wi-Fi, and/or cellular technology in your device.  The information collected may be used to match you with clients and/or suggest changes to your location preferences.  You always have the option to disable collection of location information from your device’s settings. 

 

In addition, we may use automated technology, such as a chatbot, to communicate with you through the App.   

How We Use Your Information  

We use information that we collect about you or that you provide to us, including any personally identifiable information:

• To provide you with the App and its contents, and any other information, products or services you requested from us. 
• To fulfill any purpose for which you provide it. 
• To manage our relationship with you, such as asking you to take a survey or provide feedback on our services. This is necessary to keep our records up-to-date and to study how our customers use our services so that we can develop and improve our business. 
• To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including billing and collection.
• To notify you when App updates are available, and of changes to any products or services we offer or provide through it. 
• For any other purposes with your consent. 

Disclosure of Your Information  

We may disclose information that we collect about you or that you provide us, including any personally identifiable information:

• To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.    
• To our affiliates and parent company.
• To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by us about our App users is among the assets transferred.
• To unaffiliated third parties when we believe its release is appropriate to comply with the law, enforce or apply our Terms and Conditions and other agreements, or protect the rights, property or safety of our company, our users or others. This includes exchanging information with other unaffiliated third parties in connection with fraud protection and credit risk reduction.
• To comply with a legal process, such as a court order, subpoena, search warrant, or law enforcement request. 
• To the broker you are employed by or affiliated with, and to other agents employed by or affiliated with your broker, in accordance with the present Agreement between us and you.

We may disclose without restriction aggregated information about our users and information that does not identify an individual. 

Accessing and Correcting Your Personal Information 

 

You can review and change your personal information by logging into the App and visiting your account profile page. 

 

Data Security

 

We have in place what we believe to be reasonable physical, electronic and managerial procedures to safeguard and help prevent unauthorized access of, maintain data security for and correctly use the personal information you have provided. HOWEVER, WHILE SUCH EFFORTS ARE INTENDED TO ENSURE THE CONFIDENTIALITY OF YOUR PERSONAL INFORMATION AVAILABLE TO US AS A RESULT OF YOUR USE OF OUR APP, WE CANNOT AND DO NOT WARRANT OR GUARANTEE THE ABSOLUTE SAFETY AND SECURITY OF YOUR PERSONAL INFORMATION.

 

It is important for you to protect against unauthorized access to your password and your mobile device(s). Additionally, change your passwords often using a combination of letters and numbers, and make sure you use a secure web browser.

Your California Privacy Rights

If you are a California resident, you may have the right to request and receive information about disclosure of your personally identifiable information to third parties for their direct marketing purposes. Because it is our policy not to share your personally identifiable information with third parties for third party direct marketing purposes without your consent, we are exempt from the requirement to respond to such requests.
