To be eligible to participate in the Rewards Program, you must satisfy each of the following conditions:
1. Speak to a PrimeStreet team member over the telephone and allow the team member to connect you with an agent to assist you with the purchase or sale of your real estate;
2. Purchase or sell real estate in an eligible area, as designated by PrimeStreet, with the assistance of the agent with whom the PrimeStreet team member connected you (or that agent's broker) within twenty-four (24) months.
Eligibility. The Rewards Program is open only to individual consumers acting in a personal capacity, and not to businesses, investors purchasing on behalf of an entity, or any person who holds an active real estate license in any jurisdiction. You must be at least eighteen (18) years old and have the legal capacity to enter into these terms.
Claims Deadline. To receive a Rewards Program payment, you must submit a complete claim, including all information and documentation required by PrimeStreet, within thirty (30) days after the closing of the applicable purchase or sale. Claims submitted after this thirty (30) day period will not be honored, and PrimeStreet has no obligation to provide notice or a cure period before a claim is forfeited on this basis.
You are not eligible to receive a Rewards Program payment unless and until your agent and/or your agent's broker has paid to PrimeStreet, as a share of the commission earned on the purchase or sale of your real estate, the full amount contracted between PrimeStreet and that agent and/or broker. If PrimeStreet's compensation in connection with your purchase or sale is not a share of commission (including, without limitation, a flat, per-lead, or other fee not tied to the commission earned on the transaction), no Rewards Program payment is owed or will be paid, regardless of whether you otherwise satisfy the conditions of this program.
Rewards Program amounts are not guaranteed. You can generally expect to receive your Rewards Program payment within sixty (60) days after you have provided all information and documentation required by PrimeStreet and your agent and/or your agent's broker have paid PrimeStreet its full commission share on the transaction. The Rewards Program payment may be made in the form of cash, gift card or otherwise as reasonably determined by PrimeStreet.
Only real estate purchases and sales are eligible for the PrimeStreet Rewards Program. Leases and other transactions are not eligible for the Rewards Program. The Rewards Program is available only in certain areas. The Rewards Program is not available where prohibited by law (including, without limitation, Alabama, Alaska, Iowa, Kansas, Louisiana, Mississippi, Missouri, New Jersey, Oklahoma, Oregon, and Tennessee) or wherever PrimeStreet, in its sole discretion, does not choose to offer the Rewards Program.
Program Integrity. PrimeStreet reserves the right to deny, withhold, or reclaim a Rewards Program payment, and to disqualify a participant, if PrimeStreet determines, in its sole discretion, that a claim is fraudulent, that the participant has submitted false or misleading information, or that the participant has attempted to circumvent these terms. This includes, without limitation, submitting inquiries or claims under different identities, or artificially splitting or structuring what is in substance a single real estate transaction into multiple claims in order to obtain more than one Rewards Program payment.
Tax Reporting. Rewards Program payments may be considered taxable income to you. PrimeStreet may require you to complete a Form W-9 or equivalent before issuing payment and may report payments to applicable tax authorities as required by law. If you are a PrimeStreet employee or otherwise affiliated with PrimeStreet, your Rewards Program payment may instead be processed and reported through payroll, and PrimeStreet may withhold applicable taxes accordingly. PrimeStreet does not provide tax advice; you should consult your own tax advisor regarding the tax treatment of any Rewards Program payment.
Non-Transferability. Rewards Program eligibility and payments are personal to the participant and may not be transferred, assigned, or sold to any other person or entity.
Program Changes. PrimeStreet reserves the right to modify, suspend, or discontinue the Rewards Program, in whole or in part, at any time and without prior notice, including as to eligible areas, reward amounts, and payment timing. Changes will not affect a claim that PrimeStreet has already approved for payment prior to the change.
Final Determination. PrimeStreet has sole discretion to interpret and apply these terms and to determine eligibility, claim validity, and reward amounts. All such determinations are final.
